The Labour Code allows employees to take unpaid leave in a number of specific cases, but employers may also allow employees to take unpaid leave for other reasons.

However, it should always be for reasons concerning the employee, not situations in which the employer is unable to assign the employee work due to obstacles on the employer’s part. Moreover, an agreement between the employee and the employer cannot be used to sidetrack this hypothetical restriction. Thus, these cases clearly show strong protection for the employee.
